Terms & Conditions

Effective Date: December 16, 2025

These Terms and Conditions (“Terms”) govern your access to and use of the House of Honey mobile application (“App”), operated by House of Honey LLC (“Company,” “we,” “us,” or “our”). By downloading, creating an account, or using the App, you agree to these Terms.

If you do not agree, do not use the App.

1. Eligibility

  • You must be at least 13 years old to use the App.
  • Users under 18 must have permission from a parent or legal guardian.

2. User Accounts

To access certain features, you must create an account. You agree that:

  • All information provided is accurate and current.
  • You are responsible for safeguarding your login credentials.
  • You are responsible for all activity conducted through your account.

We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, including for suspected fraud, abuse, or violation of these Terms.

3. Ordering, Pickup & Modifications

The App allows users to place orders for pickup at House of Honey locations in Peoria, Arizona and Goodyear, Arizona.

Pickup Times

  • Pickup times are estimates only.
  • Delays may occur due to volume, staffing, equipment, or other operational factors.
  • We do not guarantee preparation or pickup times.

Order Modifications

  • Orders may be modified up to 10 minutes before the estimated pickup time.
  • After that window, orders cannot be modified, cancelled, or refunded, except where required by law.

4. Payments & Refund Policy

All payments are processed through secure third-party payment processors (such as Apple, Google, or other providers).

  • Prices are shown before checkout.
  • All sales are final unless otherwise required by law.
  • We are not responsible for payment processor errors, delays, or interruptions.

Chargebacks, fraudulent disputes, or abuse of the refund process may result in account suspension or termination.

5. Allergens, Ingredients & Food Safety Disclaimer

By using the App and placing orders, you acknowledge and agree that:

  • Food and beverages may contain or come into contact with common allergens, including but not limited to dairy, nuts, soy, gluten, and eggs.
  • Cross-contamination may occur despite reasonable precautions.
  • Custom drink requests are fulfilled at the user’s own risk.

House of Honey LLC is not responsible for allergic reactions, sensitivities, or adverse health effects resulting from consumption of any product.

6. Multiple Locations & Availability

Menus, pricing, availability, promotions, rewards, and operating hours may vary by location.

We reserve the right to:

  • Modify offerings by location.
  • Limit quantities.
  • Substitute ingredients when necessary.

7. Loyalty Program, Rewards & Credits

The App may offer loyalty points, rewards, promotions, or stored credits. You acknowledge that:

  • Rewards have no cash value.
  • Rewards may expire.
  • Programs may be modified, suspended, or terminated at any time without notice.
  • Fraudulent use voids all rewards.

8. Prohibited Use

You agree not to:

  • Use the App for unlawful purposes.
  • Attempt to hack, disrupt, or reverse-engineer the App.
  • Engage in abusive, fraudulent, or misleading behavior.
  • Interfere with App functionality or other users.

Violations may result in immediate termination.

9. Intellectual Property

All App content, including branding, logos, menus, images, text, and software, is owned by House of Honey LLC and protected by intellectual property laws.

No content may be copied or reused without written permission.

10. User Content

If you submit feedback, reviews, or other content, you retain ownership but grant us a royalty-free, perpetual, non-exclusive license to use it for App operations, marketing, and improvements.

We reserve the right to remove content at our discretion.

11. Privacy

Use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect user information. By using the App, you consent to these practices.

12. App Availability & Changes

The App is provided “as is” and “as available.” We do not guarantee:

  • Continuous availability.
  • Error-free performance.
  • Data retention.

We may modify, suspend, or discontinue the App or any feature at any time.

13. Third-Party Services

The App integrates with third-party services, including payment processors and platform providers. We are not responsible for third-party content, policies, outages, or actions.

14. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

15. Limitation of Liability

To the maximum extent permitted by law, House of Honey LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the App, orders, delays, or food consumption.

16. Indemnification

You agree to indemnify and hold harmless House of Honey LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

17. Termination

We reserve the right to terminate or suspend access at any time, with or without notice, for any lawful reason.

18. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
